Will the Herbicide Manufacturer Compensate Me for My Damages?
When we file a lawsuit on our clients’ behalf, we are seeking compensation for their related physical, psychological, and financial harm. This is how we hold the at-fault parties responsible. So, in a suit based on your Parkinson’s disease diagnosis and treatment, recoverable damages could include:
- Medical care and related expenses
- Future care costs
- Lost wages and diminished earning ability if you cannot work
- Pain and suffering losses
- Reduced quality of life
- Other related damages
If your family member died from Parkinson’s disease, you may have a case for wrongful death damages. Also, this recovers compensation for the harm suffered by designated surviving family members.
Anastopoulo Law Firm may seek punitive damages in your case as well. These rare damages are meant to penalize the liable party for particularly bad behavior. However, they are not common in most personal injury cases. But, sometimes available in defective product cases and other mass torts.

What Is Paraquat Dichloride, and Why Is It Dangerous?
For decades, paraquat dichloride was one of the most commonly used herbicides. The toxic chemical was in many preparations used for weed and grass control, although there are now strict restrictions for its use.
Today, paraquat products in the United States have warning labels about the dangers of exposure, as the product is highly toxic. These products are also now restricted use pesticides (RUPs), according to the United States Environmental Protection Agency (EPA). This means that those wishing to use paraquat must undergo training and complete certification.
In addition, several recent studies have linked paraquat use to an increased risk of Parkinson’s disease. This includes peer-reviewed research published in:
The American Journal of Epidemiology
This 2009 study found that those exposed to paraquat and another herbicide, maneb, near their home increased their risk of Parkinson’s disease by 75 percent.
JAMA Neurology
This 2009 study in this journal published by the American Medical Association (AMA) found that the risk of Parkinson’s disease increased with pesticide/herbicide use.
Cell Death & Differentiation
This 2010 review of epidemiological studies looks at the link between paraquat exposure and Parkinson’s disease.
Environmental Health Perspectives
This 2011 study looked at the role of oxidative stress from pesticides, such as paraquat, and its role in the development of Parkinson’s disease. It found a positive association.

Is There Pending Multidistrict Litigation Related to Paraquat?
The Judicial Panel on Multidistrict Litigation centralized the paraquat lawsuits into MDL 3004 in June 2021. The Southern District of Illinois now oversees these cases for pretrial motions, discovery, and bellwether trials. The way an MDL works is that the court consolidates the cases for the initial stages through the first trials. These trials offer a look at how juries in each case’s original jurisdiction will likely rule.
This often spurs settlements from defendants who do not want to go to trial in courts across the country when there is a good chance they will lose. Following the bellwether trials, any unsettled lawsuit will return to its original jurisdiction for trial.
What is the current status of MDL 3004?
Per the Judicial Panel on Multidistrict Litigation’s August 2021 report, almost 200 cases were pending in the MDL. This number will likely grow exponentially as more people learn about the possibility of compensation for their Parkinson’s care and support.
